Final NIH Policy for Data Management and Sharing (NOT-OD-21-013)
"The National Institutes of Health (NIH) Policy for Data Management and Sharing (DMS) reinforces NIH's longstanding commitment to making the results and outputs of NIH-funded research available to the public through effective and efficient data management and data sharing practices."
A Nature article regarding FAIR practices can be found here.
"Under the DMS Policy, NIH requires researchers to prospectively plan for how scientific data will be preserved and shared through submission of a Data Management and Sharing Plan (Plan). Upon NIH approval of a Plan, NIH expects researchers and institutions to implement data management and sharing practices as described. The DMS Policy is intended to establish expectations for Data Management and Sharing Plans, which applicable NIH Institutes, Centers and Offices (ICO) may supplement as appropriate."
Here are the main definitions as stated in the NIH Data Management & Sharing Policy:
Scientific Data does not include:
- laboratory notebooks -completed case report forms - plans for future research - communications with colleagues
- preliminary analyses -drafts of scientific papers - peer reviews - physical objects, such as laboratory specimens

Data Preservation and Sharing Timelines: "Shared scientific data should be made accessible as soon as possible, and no later than the time of an associated publication, or the end of performance period, whichever comes first."
"Researchers are encouraged to consider relevant requirements and expectations (e.g., data repository policies, award record retention requirements, journal policies) as guidance for the minimum time frame that scientific data should be made available, which researchers may extend."
Considerations for Scientific Data Derived from Human Participants:
Post Funding or Support: "After the end of the funding period, non-compliance with the NIH ICO-approved Plan may be taken into account by NIH for future funding decisions for the recipient institution (e.g., as authorized in the NIH Grants Policy Statement, Section 8.5, Special Award Conditions, and Remedies for Noncompliance (Special Award Conditions and Enforcement Actions))."
